INTRODUCED BY ALDERMAN BENNICE JONES-KING

An ordinance establishing a special account to be known as the Lead Remediation Account; authorizing and directing the Comptroller to establish the above account; directing certain funds to be placed in said Account, and authorizing and directing the Director of Health and Hospitals, upon approval of the Board of Estimate and Apportionment to spend said funds, by contract or otherwise, for the detection, containment and remediation of lead in residential property and for the support and maintenance of a safe house for temporary occupancy of said residents or in the direct delivery of services to lead poisoned children or the prevention thereof. and containing an emergency clause.

BE IT ORDAINED BY THE CITY OF ST. LOUIS AS FOLLOWS:

SECTION ONE. There is hereby established a Special Account to be known as the Lead Remediation Account. The Comptroller is hereby authorized to set up and maintain said Account.

SECTION TWO. All income derived from Medicaid reimbursement for the delivery of lead services, including income collected for the delivery of lead services, including income collected for the delivery of medical, case management, environmental and laboratory services, and grants and gifts for the detection, containment and remediation of lead contamination and the establishment, support and maintenance of a safe house for the residents temporarily removed from their premise while said premise is being treated for lead and all fines, but not court costs, collected for violation of any ordinance pertaining to lead poisoning shall be placed in said Account.

SECTION THREE. The Director of Health and Hospitals, with the approval of the Board of Estimate and Apportionment, is hereby authorized to expend the funds in said Account, by contract or otherwise, for the detection, containment and remediation of lead contamination in residential property and for the establishment, support and maintenance of safe houses for the temporary occupancy of said residents. The Director of Health and Hospitals shall promulgate rules for the expenditure of said funds.

SECTION FOUR. Emergency clause.

This ordinance, being necessary for the immediate preservation of the public peace, health and safety, shall be and is hereby declared to be an emergency measure within the meaning of Article IV, Section 20, of the Charter of the City of St. Louis, and as such shall take effect immediately upon its approval by the Mayor.
