INTRODUCED BY ALDERMAN FRANCIS SLAY, STEPHEN GREGALI, KENNETH ORTMANN, ALFRED WESSELS, LYDA KREWSON, KENNETH JONES, STEPHEN CONWAY, DIONNE FLOWERS

An ordinance pertaining to the Property Maintenance Code and the Building Code; allowing the code official to post and publish a notice whenever a building, structure or premise is referred to the municipal division of the Circuit Court for prosecution of code violations if the building, structure or premise has been condemned for occupancy within the previous twelve months or if the building, structure or premise has been referred to the municipal court division for violations of the codes on more than two (2) occasions within the past twelve (12) months; specifying the manner in which the notice is to be posted and the contents of such notice.

BE IT ORDAINED BY THE CITY OF ST. LOUIS AS FOLLOWS:

SECTION ONE. A. Whenever the code official determines that a building, structure or premise is in violation of the Property Maintenance Code or the Building Code and such violation is referred to the municipal court division of the Circuit Court for prosecution, the code official may post a notice in a manner set forth in Section Two of this ordinance if:

a. The building, structure or premise has been condemned for occupancy at any time within a previous twelve (12) months; or

b. The building, structure or premise has been referred to the municipal court division for violations of this code on more than two (2) occasions within the past twelve (12) months.


SECTION TWO. Such notice prescribed in Section One shall:
a. Be a placard containing the words “Notice of Housing Court Action” printed in large type, to be placed at each end of the block in which the building, structure or premise is located not more than ten (10) days prior to the date of the court hearing.

b. Include a description of the building, structure or premise sufficient for identification;

c. Include the name and address of the owner(s) of the building, structure or premise;

d. Include the date, time and location of the court hearing;

e. Include a statement of the reason or reasons why the building, structure or premise has been referred to the municipal court;

f. Include a statement advising any interested party that they may attend the court hearing for the purpose of observing the proceedings.


SECTION THREE. In addition to said posting, the code official may publish in any newspaper circulated in the City of St. Louis and/or St. Louis County any items described in Section Two hereof.
