22.20.010 Term--Rules and regulations.

The board of public service is authorized and empowered to let to the highest responsible bidder concession privileges in the public parks of the city for terms not to exceed five years under rules and regulations drawn up by the director of parks, recreation and forestry and approved by the board of public service.

22.20.020 Advertising for bids.

Before letting concession privileges the board shall advertise for bids in the City Journal at least ten days before the opening of bids. The board shall have the authority to reject any and all bids. In case all bids are rejected, the board shall immediately proceed to advertise anew for bids and to continue to do so until the concession privileges are let according to the terms of Sections 22.20.010--22.20.050. Prior to advertising for bids, the board of public service shall designate the public parks in which authorization to operate the concession privileges shall be granted, the type and character of the concessions, the space to be occupied, such as buildings and other facilities, by the licensee, and shall refer to same in the advertisement.

22.20.030 Performance bond.

The successful bidders shall execute and file in the office of the city register within thirty days after their bid is accepted performance bonds to the city in the sum equal to twenty-five percent of the estimated annual contractual payments by the successful bidders to the city (but in no case shall the bonds be in the sum of less than one thousand dollars), with good and sufficient sureties to be approved by the Comptroller conditioned for the prompt payment to the City of all sums agreed to be paid in consideration of the grant of the privileges, and further conditioned that the premises will at all times be kept in a neat, clean, sanitary and orderly condition to the satisfaction of the Director of Parks, Recreation and Forestry, and that only reasonable prices will be charged.

22.20.040 Rent--Premises inspection.

In all cases the rents are to be paid in advance.

The premises shall at all times be open to the inspection of the Director of Parks, Recreation and Forestry.

22.20.050 Forfeiture of privileges.

Any failure on the part of the licensee of the privileges to comply with any of the terms or provisions of Sections 22.20.010--22.20.050, or of any contract or bond made in pursuance thereof, shall work a forfeiture of the privileges granted and upon forfeiture the Director of Parks, Recreation and Forestry shall take possession of the premises and exclude said licensee therefrom.

22.20.060 Skate concessions--Terms.

The Board of Public Service is authorized and empowered to let to the highest and best bidders the privileges of selling, renting, storing and/or repairing roller skates and ice skates and their accessories at the Mark C. Steinberg Memorial Skating Rink in the building provided for such use in Forest Park for a term not less than three years nor more than five years. Awards may be made and contracts entered into for such privileges within six months prior to the time that the skating rink and building shall be ready for operation or any time thereafter. The advertising, bidding and letting of the contract or contracts for such privileges shall be pursuant to rules and regulations drawn up by the Commissioner of Parks and Recreation consistent with the terms of Section 22.20.010--22.20.090 and approved by the Board of Public Service.

22.20.070 Skate concessions--Advertising for bids.

Before letting the contract or contracts for such privileges, the Board of Public Service shall advertise for bids in the City Journal at least ten days before the opening of the bids. The Board shall have the authority to reject any and all bids. In case all bids are rejected, the Board shall immediately proceed to advertise anew for bids, and shall continue to do so until the privileges are let according to the terms of Sections 22.20.060--22.20.090. Prior to advertising for bids, the Board of Public Service shall designate the space to be occupied by the successful bidders, the numbers, characters, and sizes of booths or counters, owned by the City, and to be used by the bidders, and shall refer to same in the advertisements. In all cases the rents are to be paid in advance.

22.20.080 Skate concessions--Bond.

The successful bidders shall execute and file in the office of the City Register within thirty days after their bids are accepted, penal bonds to the City in the sum of one thousand dollars each, with good and sufficient sureties to be approved by the Mayor and Board of Aldermen conditioned for the prompt payment to the City of all sums agreed to be paid in consideration of the grant of the privileges, and further conditioned that the premises will at all times be kept in a neat, clean, sanitary and orderly condition, to the satisfaction of the Commissioner of Parks and Recreation, and that they will charge only prices for sales, rentals and services as are approved by the Commissioner of Parks and Recreation subject to the approval of the Director of Public Welfare.

22.20.090 Premises inspection.

The premises shall at all times be open to the inspection of the Commissioner of Parks and Recreation. Any failure on the part of the successful bidders for the privileges to comply with any of the terms or provisions of this ordinance [Sections 22.20.060--22.20.090], or of any contract or bond made in pursuance thereof, shall work a forfeiture of the privileges granted, and upon forfeiture the Commissioner of Parks and Recreation shall take possession of the premises and exclude said successful bidders therefrom.
