Selling Merchandise on Wharves

21.40.010 Permit--Required.

No person shall occupy the wharf area between the north curb line of Chouteau Avenue and the south curb line of Biddle Street and the west curb line of Leonor K. Sullivan Boulevard and the Mississippi River for the purpose of displaying, selling or offering for sale, any goods, food or merchandise, unless said person has secured a permit or lease under the provision of this ordinance.

21.40.020 Permit--Application--Contents.

Duly licensed merchants and itinerants shall make application for a permit to be issued by the Board of Public Service for occupancy of the wharf area between the north curb line of Chouteau Avenue and the south curb line of Biddle Street and the west curb line of Wharf Street and the Mississippi River for the purpose of displaying, selling or offering for sale, any merchandise.

The permit shall:

A. Designate the specific and definite area within which the merchant or itinerant shall confine all sales activities;

B. Indicate that the cleanliness of the specific assigned area shall rest solely with the permittee and that a sufficient number, but not less than two twenty-gallon trash receptacles shall be placed by the permittee within this specifically assigned area;

C. Be issued for a maximum of six months;

D. Require an inspection fee of one hundred dollars to be paid upon the issuance of each permit to insure compliance with the provisions of this chapter.

21.40.030 Permit--Transferability--Limit.

No permit issued under the provisions of this chapter shall be assignable or transferable and no permittee shall be issued permits for more than two wharf locations.

21.40.040 Permit--Revocation.

The Board of Public Service shall revoke the permit of any duly licensed persons or itinerants for not complying with the foregoing provisions of this chapter.

21.40.050 Penalty for violation.

Any person, firm or corporation violating the provisions of this chapter shall upon conviction, be fined the sum of not less than twenty-five dollars ($25.00) nor more than five hundred dollars ($500.00) or by imprisonment for not more than ninety (90) days, or both such fine and imprisonment. Each day that any violation shall continue shall constitute a separate offense.
