Commercial Vehicle Loading

17.23.010 Prohibited hours.

Commercial vehicles are prohibited from loading or unloading goods and merchandise to commercial/retail establishments that abut or are located next to a residentially zoned property between the hours of ten p.m. and six a.m.

17.23.020 Applicability of provisions.

The provisions of Section 17.23.010 extend to and are intended to apply to any premises of a commercial nature that are located in a commercially zoned mall, shopping center, or other commercial enterprise zones that house more than one retail establishment; to the extent any retail commercial premises abuts or is located next in proximity to a residentially zoned premise, all said retail commercial enterprises found within any mall, shopping center, or other multi-faceted commercial retail establishment shall be considered as within the terms, provisions and contemplated scope of this chapter.

17.23.030 Penalty for violation.

Performance of any act prohibited by this chapter and failure to perform any act required by this chapter, shall be punishable by a sentence of not more than ninety (90) days in jail, or by a fine of not more than five hundred dollars ($500.00) or both or by any combination of sentence and fine up to and including the maximum sentence and maximum fine.
