Credit Toward Service of Sentence

16.28.010 Delays in delivery.

Any person sentenced by the city courts to service of a term in the city workhouse who is kept from commencement of service of the sentence by the factual inability of the city marshal to deliver the prisoner to the workhouse on the day of sentencing, shall be given credit toward service of the sentence for the time elapsing from the sentencing and the time of the actual delivery of his person to the workhouse.

16.28.020 City court order.

Whenever a delay occurs in the delivery of a prisoner to the workhouse due to the inability of the city marshal to deliver the prisoner on the day of sentencing according to the circumstance of Section 16.28.010, the marshal shall report the fact to the judge of the sentencing city court who shall then amend the sentence to extent of the delay by an order in writing, a copy of which shall accompany the court's judgment and be delivered to the warden of the workhouse, which officer shall treat the order as part of the judgment of the court.
