15.84.010 Untrue, deceptive or misleading.

Any person who, with intent to sell or in anywise to dispose of merchandise, securities, service or anything offered directly or indirectly by such person to the public for sale or distribution, or with intent to increase the consumption thereof, or induce the public in any manner to enter into any obligations relating thereto, or to acquire title thereto, or any interest therein, makes, publishes, disseminates, circulates or places before the public or causes directly or indirectly to be made, published, disseminated, circulated or placed before the public, in this city, in any newspaper or other publication sold or offered for sale upon any public street, sidewalk or other public place, or offered, or delivered by carrier or other agency, to any person, or any subscribers, within this city, or on any sign in any manner posted, exposed or displayed upon any street, sidewalk or public ground, or in any handbill or advertisement in any manner displayed, or posted upon any street, sidewalk or public ground, or on any placard, advertisement or handbill in any manner delivered, displayed, exhibited or carried in any street, or public ground or upon any sidewalk, or any banner or sign flying across the street or from any building or structure of any kind, an advertisement of any sort, regarding merchandise, securities, service or anything therein offered for sale to the public, which advertisement contains assertion, representation or statement which is untrue, deceptive or misleading, as to quantity, quality, character, kind, cost or value of anything therein or thereby mentioned for sale shall be guilty of a misdemeanor.

15.84.020 Affixing advertisements on any structures.

Any person who shall wilfully or maliciously paint, post, place or affix any business, commercial, amusement or exhibition advertisement, or cause same to be done, on or to any curbstone, flagstone, or any other portion of any street, or sidewalk, or upon any tree, lamppost, hitching post, telegraph pole, telephone pole, hydrant, bridge or any public structure within the city, or to any wall, window, door, fence, gate, advertising structure, building or other object, which is the property of another, without first having secured the written consent of the owner thereof, or his duly authorized agent, shall be guilty of a misdemeanor. Nothing herein shall apply to any notice required by law or ordinance to be posted, or to any official notices by public officers.

15.84.030 Statement of facts.

It is unlawful for any person engaged in the business of selling goods, wares, merchandise, securities, service or real estate to advertise the sale of the same unless it shall be stated in the advertisement of the sale, clearly and unequivocally, that the person advertising the sale of goods, wares, merchandise, securities or real estate is a dealer in the same. The advertisement of the sale of any goods, wares, merchandise, securities, service or real estate in such form as to make it plainly apparent therefrom that the person so advertising is actually engaged in the business of selling such goods, wares, merchandise, securities, service or real estate as a business, shall be sufficient compliance with the terms of this section. Any person violating the provision of this section shall be guilty of a misdemeanor.

Ordinance requiring advertisement for sale of goods to state advertiser is dealer in goods, held within power of city. City of St. Louis v. Southcombe, 8 S.W. 2d 1001 (1928).

15.84.040 False want ads.

Any person who shall in the city knowingly insert or cause to be inserted in any newspaper in the city, any advertisement falsely representing that any person desires to hire or employ any labor or services of any kind or character or to purchase or acquires any kind or character of property, and any person who shall knowingly be in anywise concerned in the insertion of any such false advertisement in any newspaper printed or published in the city shall be guilty of a misdemeanor.

15.84.070 Dispensing information for medicines for sexual problems.

Any person who shall sell or offer to sell, give or offer to give away, distribute, or have in his possession with intent to give away, sell, or distribute in or upon any street or sidewalk or park or public property in the city, any book, pamphlet, circular, handbill, advertisement or notice of any kind giving or purporting to give information from whom or where medicine or anything whatever may be obtained for the cure, prevention or treatment of uterine diseases, or diseases peculiar to females, venereal diseases of the genital organs, or nervous debility, impotency, sterility, or barrenness, private diseases, abortion or miscarriage, or articles or means of preventing conception shall be guilty of a misdemeanor.
