Vagrancy

Cases:

In a charge of vagrancy for nonsupport of one's family, intent is a necessary element. State v. Levy, 253 S.W. 64, 212 Mo. App. 142 (1923).

Ops. Atty. Gen.:

A man may be prosecuted as a vagrant under this section (V.A.M.S. 563.340) for his willful neglect or refusal to support his family even when divorced if such neglect or refusal took place prior to such divorce. No. 96, Mar. 11, 1964.

15.58.010 Vagrant defined.

The following classes of persons shall be deemed vagrant within the meaning of this chapter:

A. Every person without any visible means of support who may be found loitering around houses of ill-fame, gambling houses or places where liquors are sold or drunk;

B. Every person who shall be engaged in practicing any trick or device to procure money or other thing of value;

C. Every person who shall be engaged in any unlawful calling whatever;

D. Every able-bodied married man who shall neglect or refuse to provide for the support of his family;

E. Every person found tramping or wandering around from place to place without any visible means of support.

15.58.020 Misdemeanor.

Any person who shall be convicted of being a vagrant within the meaning of this chapter, shall be guilty of a misdemeanor.
