Yard Sales

15.156.010 Prohibited--Front yard defined.

A. It shall be unlawful to conduct any sale at retail in the front yard of any residentially zoned property, as the term "front yard" is herein defined, which said sale is known as a yard sale, garage sale or lawn sale.

B. "Front yard" means a yard measured across the width of the entire lot and situated between the front lot line and the nearest portion of the main building other than steps, unenclosed balconies or unenclosed porches.

15.156.020 Prohibited--Display--Festival permit for sidewalk use.

A. It shall be unlawful to display, show or otherwise exhibit any goods, chattels or other personalty to be sold at said lawn sale, yard sale, garage sale or, any retail sale conducted at a residentially zoned structure, in the front yard of said residence as herein defined.

B. No person or group of persons shall be permitted to conduct a yard sale, garage sale or lawn sale, or activities of substantially the same character, being activity as defined in this chapter unless they have first obtained a festival permit as provided by Chapter 20.46 to use the public sidewalk or streets the area on which said activity is to be conducted.

15.156.030 Penalty for violation.

Any person found guilty of violating the provisions of this chapter shall be fined not less than fifty dollars ($50.00) nor more than five hundred dollars ($500.00) or imprisonment for not more than ninety (90) days or both such fine and imprisonment.
