11.66.010 Permit--Required. 11.66.010 Permit--Required. The owner or occupant of any premises shall not permit sand, gravel,
other similar aggregates having a particle size of less than one-half-inch
diameter to be openly stored or piled at a height of twenty feet or more or
loose materials if loaded out by the use of a conveyor to be openly stored
or openly piled at a height greater than ten (10) feet, without first
obtaining a permit from the Board of Public Service. The application for a
permit shall contain a description and plat of the land proposed to be used
for such open storage or piling and such other information the Board may
reasonably require. Permits shall be issued by the Board of Public Service
and shall contain such conditions and terms which the Board deems necessary
to protect the public health and safety. 11.66.020 Permit--Effective period--Renewal. Permits required by the chapter shall be effective for one year and shall
be renewed annually, and the initial permit must be applied for to the Board
of Public Service within thirty days after the effective date of this
ordinance. Editor's Note: Ordinance 59481 was approved July 5, 1985. 11.66.030 Fencing requirements--Gates. In addition to the other conditions and terms that the Board of Public
Service may deem necessary to protect the public health and safety, all such
premises, or those portions immediately adjacent to where such sand, gravel,
similar aggregates, or loose materials are openly stored or openly piled,
shall be enclosed by a chain-link fence at least eight (8) feet in height
with a minimum of three strand barb wire attached at the top, unless the
premises is fully enclosed by a fence prior to the effective date of this
ordinance. Any gates for any fence must be locked except when opened for
authorized ingress and egress from the premises. At such times when the
gates are open the opening shall be protected from unauthorized entry by an
attendant; or the gates shall have an automatic gate release system that
activates from the exterior by authorized personnel, but prevents
unauthorized entry. 11.66.040 Fencing requirements--Flood wall exception. The fencing requirement of this chapter shall not apply to any premises
that is located directly east of where the flood wall is located. 11.66.050 Penalty for violation. Any owner, licensee or other person, firm, corporation or partnership
convicted of violating this chapter shall be punished by a fine of not less
than one hundred ($100.00) nor more than five hundred dollars ($500.00), or
by imprisonment for not more than ninety (90) days, or by both such fine and
imprisonment. Each day that any violation shall continue shall constitute a
