11.44.360 Definitions.

For the purpose of this part certain words and terms are hereby defined as follows:

A. "Open air farmers and produce market" mean any privately owned or operated open-air market for the sale of fruit, eggs, and produce at retail or wholesale;

B. "Operator" means any person, firm or corporation who rents, lets or sublets space in an open air farmers and produce market, or who sells in an open air farmers and produce market.

11.44.370 Permit--Required.

It shall be unlawful to operate an open air farmers and produce market without first securing a permit to do so from the board of public service.

11.44.380 Permit--Application.

Every operator now engaging in or desiring to engage in the business of an open air farmers and produce market shall file an application with the building commissioner on a form approved by the board of public service stating:

A. The name and address of the operator;

B. Proposed location to be used;

C. Zoning district in which the proposed site is located;

D. A plan setting forth the size and area of site to be used; location of sanitary facilities therein; rental spaces clearly marked thereon, location of fire lanes, arrangement for the disposition of garbage, offal and liquid waste;

E. All other pertinent information required by the board of public service.

11.44.390 Permit--Investigation--Issuance.

Upon receipt of said application and upon the payment of the ten dollar filing fee to the building commissioner, the building commissioner shall make investigation to ascertain whether or not the provisions of this part have been met, provided further that under no condition shall said sum or any part thereof be refunded if the board of public service refuses to grant the permit. Upon completion of the investigation, the building commissioner shall forward his recommendations as to whether or not the permit shall be granted to the board of public service. If the board of public service finds that all the provisions of this part have been met, it shall issue a permit to the operator.

11.44.400 Grading--Pavement.

All parcels of land used for an open air farmers and produce market shall be paved with bituminous, concrete, or equivalent surfacing and shall be graded and maintained to prevent drainage onto adjoining property, alleys, sidewalks or streets.

11.44.410 Sanitary facilities--Hose connections.

All open air farmers and produce markets shall be provided with proper sanitary facilities consisting of one toilet and one lavatory with running water. There shall be one lavatory and one toilet for each ten thousand or less square feet of market area. There shall be one or more hose connections connected to an adequate water supply provided for each ten thousand square feet of market area, and so located that all parts of the area may be reached by a hose one hundred feet in length.

11.44.420 Securing stands, counters and temporary shelters.

All stands, counters and temporary shelters shall be adequately secured to the around or pavement in accordance with the rules promulgated by the building commissioner for the operation of such market.

11.44.430 Refuse containers.

The operator shall furnish a sufficient number of refuse containers which shall be water tight, noncorrosive and tightly covered and adequate to hold all accumulations of garbage, offal and liquid waste from such operation.

11.44.440 Fires lanes.

Fire lanes, twelve feet in width, shall be clearly marked with white lines on the pavement, and each rental space shall be clearly marked with white lines on the pavement.

11.44.450 Containers.

Boxes, crates, barrels, cartons and other containers must be kept clean and stored in neat piles at all times.

11.44.460 Off-street parking.

Off-street parking shall be provided for customers in accordance with the requirement for retail stores under Chapter 26.44.

11.44.470 Inspections.

The building commissioner shall inspect or cause to be inspected all open air farmers and produce markets at least once a year to ascertain whether the market meets the requirements of this part. A fee of five dollars shall be charged the operator for such inspection.

11.44.480 Hearings--Revocation of permit.

Whenever the building commissioner finds any open air farmers and produce market in violation of any of the requirements of this part, he shall immediately notify the operator thereof to correct or abate same. If the violation is not abated within a reasonable period, the building commissioner shall file a report of such violation with the board of public service with his recommendation to revoke said permit. The board shall notify the operator in writing within a reasonable time of the building commissioner's recommendation and shall within a reasonable time, not more than thirty days after receiving the building commissioner's recommendation, conduct a hearing as to whether the permit should be revoked. If the board finds that market to be in violation of the provisions of this part, the board shall forthwith revoke the permit.

11.44.490 Service of notices.

All notices required to be served upon the operator under the provisions of this part shall be deemed served if a copy thereof shall:

A. Be delivered to him personally; or

B. If not found, by leaving a copy at his usual place of abode, with a member of his family of sixteen or more years of age; or

C. By posting a copy in a conspicuous place in or about the market affected by the notice; or

D. By sending a copy of the notice by registered letter with a return receipt requested, to the home address of operator specified in the application for the market; or

E. If registered letter with copy is returned with receipt showing it has not been delivered to him, by posting a copy thereof in a conspicuous place in or about the market.

11.44.500 Zones--Hours.

Operation of any open air farmers and produce market in the "F" local business; "G" commercial and "H" commercial zones prohibited between the hours of nine p.m. and seven a.m. and on Sunday. In the "F" local business district, sales shall be at retail only.

11.44.510 Products prohibited for sale.

Open air produce or farmers markets are hereby prohibited from selling or offering for sale poultry, meat or meat products, fish, and milk or milk products.

11.44.520 Enforcement.

It shall be and is hereby declared the duty of the department of police to assist in the enforcement of the provisions of this chapter.
