11.36.010 Screening.

No person shall at any time within the period beginning with the first day of May and ending with the last day of October, in any year, place, keep, expose, offer or prepare for sale to the consumer, nor shall sell nor shall store pending delivery of the same to the consumer, any article or substance of human food or drink in any place or premises in the City which is or are not at such time screened so as to prevent flying insects from having access to such article, or substance. No person shall at any time within such period in any year, carry, haul or convey for sale or delivery to the consumer, or place or keep or cause to be placed or kept in or upon any vehicle, within, upon, along or over any street, lane or alley or other public place or way in the City, for sale to the consumer, any article or substance of human food or drink, unless such article or substance at such time and place be covered, screened or otherwise protected in such manner as not to be accessible to flying insects; provided, however, no provisions of this section shall apply to or affect any article or substance of human food or drink, which at the time and place charged shall be in the possession of the owner thereof and intended exclusively for his own individual consumption; provided further, that no provision hereof shall apply to or affect any article of human food or drink which shall be in an unbroken container, tightly closed; and, provided, further that no provision hereof shall apply to or affect the sidewalk display, when not otherwise prohibited, of any article or substance of human food that must be peeled, pared or cooked before being fit for consumption, except meat and meat products.

11.36.020 Sidewalk display.

No person shall cause or permit the sidewalk display of any article or substance of human food or drink whatsoever for sale or delivery to the consumer at a height of less than eighteen inches above the surface of the sidewalk.

11.36.030 Transportation.

No person shall transport or convey over any street, alley or other place in the city, or shall keep on any truck or other vehicle while the same is standing on or being moved over any street, alley or other public place in the city, any article or substance of human food for sale or delivery, unless the same be protected by some covering sufficient to exclude all dust, dirt and other foreign matter; provided, however, that this section shall not apply to any of the merchandise, articles or things while the same are being received by those who do not sell the same directly to the consumer.
