Transportation of Certain Substances on Streets

11.14.010 Permit--Required.

No person, firm, or corporation shall transport or cause to be transported in any commercial vehicle any unpackaged earth, dirt, clay, mud or other similar substance on the public streets without first having obtained a permit from the board of public service.

11.14.020 Permit--Application.

Any person, firm, or corporation intending to transport or cause to be transported any unpackaged earth, dirt, clay, mud or other similar substance on the public streets shall file an application with the board of public service accompanied by a fee of five dollars. Said application shall set forth:

A. The name and address of the person, firm, or corporation;

B. The name and address to whom correspondence in relation to the application should be addressed;

C. The number and type of commercial vehicles to be used in transporting;

D. The number of days the transporting activity is to take place;

E. The estimated quantity of substances to be transported;

F. Other information the board of public service may require.

11.14.030 Bond.

The board of public service may grant a permit to transport or cause to be transported in a commercial vehicle unpackaged earth, dirt, clay, mud, or other similar substance on the public streets subject to such limitations and conditions as the board deems appropriate in order to protect the public streets from the deposit of such substances and for the safety of the public. In addition, the board may, either before or after the issuance of such permit, require the deposit of a bond or cash sufficient to cover the cost of removing any substance from the street caused by the activities of the permittee hereunder and any damage which may be sustained to persons or to private or to public property. Failure to provide such bond shall be cause for refusal to issue the permit or for revocation of the permit.

11.14.040 Notice of route--Filing.

Any permittee before transporting under this permit shall file a notice of the intent to transport setting forth the routes intended to be used with the director of streets. Such notice shall be filed at least three days prior to commencement of the transportation contemplated in such notice. Such notice shall be filed whenever any route change is made or the origin or destination of the substance is made. If said route or routes are not used for a period of thirty days or more, then a new notice for such routes shall be filed with the director of streets.

11.14.050 Notice of route--Required.

No permittee shall transport or cause to be transported in a commercial vehicle any unpackaged earth, dirt, clay, mud or other similar substance on the public streets without first having filed the notice described in Section 11.14.040 with the director of streets.
