11.08.350 Applicability.

11.08.180 Powers of employees of Health Division and Fire Prevention Bureau.

Duly authorized employees of the Health Division and of the Fire Prevention Bureau shall have access to all buildings to be fumigated and may summarily stop, or require the ventilation of, any fumigation which is being conducted in violation of the ordinances of the City or rules or regulations adopted under the provisions of this part, or in a manner dangerous to human life.

24.238 Fumigation of buildings

11.08.190 Authority of Fire Department.

If a fire occurs in the immediate vicinity of the fumigation, the Chief of the Fire Division, or his duly authorized representative, may, at his discretion, cause the building under fumigation to be immediately ventilated by the fumigant operator.

11.08.200 Interfering with or hindering fumigation.

No person, except as authorized herein, shall interfere with or hinder a licensed fumigant operator or license fumigant operator's helper in complying with the provisions of this part. No person shall break through barricades or refuse to heed warning signs or guards which may be required by the provisions of this part.

11.08.210 Humans in buildings being fumigated.

No building or enclosed space shall, during the period of fumigation, be occupied by human beings. It shall be the duty of the fumigant operator to make, or cause to be made, a careful examination of all parts of such buildings, or enclosed space in order to verify that no human beings have remained therein, and that all necessary precautions have been undertaken to safeguard the lives and health of all persons occupying buildings adjoining that in which the fumigation is to be performed.

11.08.220 Partial fumigation.

No partial fumigation of any building shall be permitted unless the whole structure is vacated; provided, that this shall not apply under extraordinary circumstances as determined by the representative of the Health Commissioner and where the complete fumigation is carried on under the direct supervision of such representative.

24.238 Fumigation of buildings

11.08.230 Premises to be sealed.

The premises to be fumigated shall be sealed in such a manner as to confine the fumigant to the space intended to be fumigated.

11.08.240 Warning signs.

Prior to the fumigation, warning signs shall be posted on all doors or entrances to the premises to be fumigated. The size, design, night illumination and wording of such warning signs shall be approved by the health commissioner and only such approved signs shall be used.

11.08.250 Notification of occupants.

Tenants and occupants of a building to be fumigated shall be notified in writing at least five hours in advance of a fumigation. Such notice may be left with a responsible person in each dwelling or occupied building unit or by attaching such notice in a conspicuous manner to the entrance door to such occupied unit.

11.08.260 Fire department and police department to be notified.

The fire department, through the alarm office, and the police department shall be notified by the health division when a permit for fumigation is issued.

11.08.270 Watchmen.

During the period fumigation is in process, a capable, alert watchman shall remain on duty at the entrance to the building or enclosed space fumigated and until the fumigation is completed and the premises are properly ventilated and again safe for human occupancy.

11.08.280 Premises not to be entered until safe.

The fumigant operator shall not permit or allow any person to enter the premises after fumigation until he has declared the premises safe for human occupancy as herein provided. Such declaration shall not be made until the fumigant operator:

A. Shall have inspected without gas mask or other means of protection every part of the premises; and

B. Shall have properly ventilated the premises by natural or artificial ventilation, by opening all enclosed spaces, by beating and shaking of absorbing materials, by reheating of premises to at least sixty degrees Fahrenheit and by other necessary ventilation methods.

In all cases, the ventilation or airing period shall not be less than six hours. The fumigant operator shall declare the premises ready for occupancy in accordance with the previous requirements in writing and shall post such signed declaration or certification conspicuously near the entrance to the fumigated premises.

11.08.290 Doors and windows to be locked.

Prior to fumigation, all doors, windows and other wall openings, except one exit door which might be used to gain entrance to the enclosed space to be fumigated, shall be securely locked or fastened. Immediately upon releasing or generating the fumigant, the remaining door or exit shall be locked and sealed.

11.08.300 Premises preparation.

Greasy and damp foodstuffs, including milk, butter, green vegetables, eggs, open liquid containers, plants, fish, birds and domestic animals shall be removed, and the main electrical switch opened prior to fumigation. All fires shall be extinguished prior to fumigation if an inflammable fumigant is used.

11.08.310 First aid equipment--Safety devices.

There shall be available at the site of fumigation such first aid equipment, safety devices and protective equipment as shall be required by the health commissioner. Such equipment shall meet the requirements of the health commissioner as to amount, design, condition, replacement parts and efficiency.

11.08.320 Persons required at fumigation.

There shall be two or more persons at every fumigation, one of which shall be a licensed fumigant operator. These persons must be present at the time of releasing the fumigant and during the initial ventilation.

11.08.330 Handling and disposition of fumigants.

Fumigants shall be handled and disposed of in such a manner as to avoid safety hazards and to prevent damage to structures or other property.

11.08.340 Adding warning substance to fumigant.

Whenever it shall be determined by the health commissioner that, as an additional precaution, there should be mixed with the fumigant some warning substance, having characteristics of smell or otherwise which will indicate the presence of such fumigant without destroying its effectiveness, such warning substance shall be added to the fumigant.

11.08.350 Applicability.

The provisions of Sections 11.08.220, 11.08.250--11.08.300, 11.08.320 and 11.08.340 shall not apply to fumigants for which only annual permits are required by Section 11.08.030.
