11.08.010 Definitions.

For the purposes of Parts I and II, the following words and phrases shall have the meanings ascribed to them in this section:

A. "Fumigant" means and includes any substance which, by itself or in combination with any other substance, emits or liberates a gas, fume or vapor, which gas, fume or vapor when liberated and used for the destruction or control of bacteria, fungi, insects, rodents or similar vermin or pests, is lethal, poisonous, noxious, explosive, dangerous or otherwise harmful to human beings;

B. A "fumigant operator" is any person who personally performs the acts involved in a fumigation;

C. A "fumigant operator helper" is a person who works as a helper or apprentice to a fumigant operator;

D. "Fumigation" means and includes any process or procedure in which a fumigant is employed, and shall include the preparation preceding release of the fumigant, the exposure period, and the elimination or ventilation period up until the time the premises fumigated are declared by the fumigant operator to be ready for reoccupation;

E. A "fumigator" is any person in general control of any fumigation.

11.08.020 Permit--Required.

No person shall perform or cause to be performed a fumigation in the City, without first having secured a fumigation permit from the Health Commissioner of the City as provided in this part.

11.08.030 Permit--Separate for each fumigation.

An individual fumigation permit shall be required for each separate fumigation in any building or portion thereof which is occupied or intended for occupancy; provided, however, that no individual permit but only an annual fumigation permit shall be required for fumigations in special rooms, vaults or tanks approved as to location, construction and ventilation by the Health Commissioner, or for similar types of fumigations as determined by the Health Commissioner; provided, also, that this chapter shall not apply to fumigations in greenhouses, mushroom houses, for horticultural fumigations, for fumigations outside of buildings, for the fumigation of grain in bins or elevators, and for fumigations performed by officials of federal, state or municipal agencies.

11.08.040 Permit--Bond.

No fumigation permit shall be issued to any applicant who shall not have furnished the City a liability bond in the amount of ten thousand dollars approved as to form by the City Counselor, and as to surety by the Comptroller of the City, conditioned that the principal shall comply with the provisions of Parts I and II and the regulations adopted as provided in Parts I and II and will indemnify any person damaged or injured by such fumigation in a manner in violation of Parts I and II or the regulations as provided in Parts I and II or in lieu thereof shall have furnished and filed with the Comptroller of the City a policy or certificate of insurance approved as to form by the City Counselor and accepted by the Comptroller of the City, insuring such applicant against any and all loss by reason of damage or injury to health or death that may result to any persons by such fumigation, which policy or certificate of insurance shall guarantee payment of all final judgments recovered against such applicant by reason of any such damage, injuries or death.

11.08.050 Permit--Application.

The application for a fumigation permit shall describe the building or portions of a building to be fumigated, shall name the fumigant operator and the fumigant operator helper who will perform the acts of fumigation, and include such other information as shall be deemed necessary by the Health Commissioner. No persons other than those named in the application and in the fumigation permit issued shall perform any of the acts of fumigation. In each case, such fumigant, operators and fumigant operator helpers shall have applied for and been issued licenses as fumigant operators and fumigant operator helpers as provided in Parts I and II.

11.08.060 Fumigant operator's license.

No person shall work as a fumigant operator unless he is a holder of a fumigant operator's license issued as provided in this part. Such license shall be renewed annually.

11.08.070 Fumigant operator helper--License--Required.

No person shall work and no employer or fumigator shall engage or allow or permit such person to work as a helper or as an apprentice to a fumigant operator unless he is a holder of a fumigant operator helper's license.

Before a helper or an apprentice is engaged, an application must be filed by the employer or fumigator for a fumigant operator helper's license signed by the apprentice and countersigned by the employer or fumigator.

11.08.080 Fumigant operator helper--License--Expiration.

A fumigant operator helper's license shall expire ninety days after date of issuance unless employment is sooner terminated or the license is otherwise revoked by the Board of Examiners of Fumigators.

11.08.090 Fumigant operator helper--Supervision.

No helper or apprentice holding a fumigant operator helper's license shall engage in any part of the work of fumigation except under the personal direction and supervision of a licensed fumigant operator.

11.08.110 Board of Examiners of Fumigators--Created--Composition.

There is created a Board of Examiners of Fumigators which shall consist of three members, two of whom shall be appointed by the Mayor and shall serve for a term of four years from the date of their appointment and until their successors are duly appointed and qualify. The qualifications and compensation of these two members shall be determined in accordance with the Charter and ordinances of the City. The third member shall be an employee of the Health Department to be designated by the Health Commissioner. He shall act as Chairman of the Board of Examiners and shall serve without additional compensation.

11.08.120 Board of Examiners of Fumigators--Rules and regulations.

The Board of Examiners of Fumigators is hereby authorized to adopt and establish rules and regulations concerning the issuance and revocation of permits and licenses under this part, and to determine whether applicants qualify for licenses and permits under the provisions of this part.

11.08.130 Board of Examiners of Fumigators--Duty before issuance of certificate for license.

Before issuing a certificate for a license to a fumigant operator, the Board of Examiners of Fumigators shall satisfy itself that the applicant is competently trained or experienced in the use of fumigants, that he knows the fundamental principles of fumigation procedures and has detailed knowledge concerning the hazards involved, precautionary or safety measures, the use of gas masks, the effects of fumigants upon foods, and other commodities, dosages and exposure periods, ventilation, conditions of safe reoccupancy, methods of first aid and resuscitation, and other details which will assure safe fumigations. Before being issued such certificate for a fumigant operator's license, the applicant shall have personally engaged in at least twenty-five complete fumigations.

11.08.140 Appeals.

Appeals from all decisions of the Board of Examiners of Fumigators may be taken to the Board of Public Service of the City, by filing written notice of appeal within fifteen days after the date of the decision of the Board of Examiners of Fumigators.

11.08.150 Issuance.

Licenses and permits shall be issued by the License Collector upon presentation of a certificate issued in accordance with the provisions of this part and signed by the Health Commissioner or his authorized representative.

11.08.160 Revocation.

No permit or license which is issued as provided in this part shall be revoked without a hearing before the Board of Examiners of Fumigators, five days written notice of which hearing shall be served in person or mailed to the last-known address of the holder of the permit or license.
