11.03.010 Findings.

The board of Aldermen of the City of St. Louis finds and declares as follows:

A. Sections 260.200 to 260.345 R.S.Mo. Supp. 1990 (the "Act") provide for the formation of solid waste management districts within solid waste management regions designated by the Missouri department of natural resources (the "Department").

B. Pursuant to the Act the Department has designated The City of St. Louis, St. Louis County, and Jefferson County as Solid Waste Management Region 3.

C. Section 260.305.3 R.S.Mo. Supp. 1990 permits counties within a solid waste management region to form a solid waste management district by adoption of an ordinance or order.

D. Section 260.300.5 R.S.Mo. Supp. 1990 permits counties wishing to participate in a solid waste management district to formulate an alternative management structure for such district in lieu of the management structure prescribed by Section 260.315 R.S.Mo. Supp. 1990; provided, however, that such district shall be governed by an executive board and comply with the provisions of the Act.

E. It is in the best interests of the citizens of the City of St. Louis and of The City of St. Louis to form, together with St. Louis County and Jefferson County, a Solid Waste Management District and to provide for a management structure for such District as hereinafter set forth.

11.03.020 Formation of district.

There is hereby formed the St. Louis--Jefferson Solid Waste Management District (the "District") effective on the date of November 15, 1991 or the last to occur of the effective dates of the ordinance codified in this chapter, a substantially identical ordinance of St. Louis County, and a substantially identical order of the Jefferson County Commission.

11.03.030 Purpose of district.

The District is formed for the purpose of performing all functions and duties of Solid Waste Management Districts under the Act as amended, shall have all powers granted to it by the Act as amended, and, pursuant to Section 260.305.2 RSMo. Supp. 1991, shall be a body corporate of the state.

11.03.040 Executive board--Composition.

The District shall be managed by an Executive Board to consist of seven (7) members for St. Louis County, four (4) members for the City of St. Louis, two (2) members for Jefferson County and two (2) members for St. Charles County. If a county not presently a part of the District hereafter joins the District, the Executive Board shall include one (1) member for such county.

11.03.050 Executive board--Member selection.

The members for the City of St. Louis shall be appointed by the Mayor and approved by the Board of Aldermen. They shall be residents of the City during their tenure. The members for St. Louis County and Jefferson County shall be appointed in a manner provided by the ordinance codified in this section or order of District. The members for St. Charles County shall be appointed in a manner designated by its County Executive and County Council. The member for any county which hereafter joins the District shall be appointed in a manner provided by the ordinance codified in this section or order of such county joining the District. The term of each member hereafter appointed shall be four years, except where the appointment is to fill an unexpired term. In such instance, the appointed member shall serve until the expiration of such unexpired term.

11.03.060 Length of terms--Vacancies.

Of the members of the Executive Board first appointed: one member for the City, two members for St. Louis County, and one member for Jefferson County shall be appointed for terms of four years from the date of formation of the District; one member for each of the City, St. Louis County, and Jefferson County shall be appointed for terms of three years from the date of formation of the District; one member for each of the City and St. Louis County shall be appointed for terms of two years from the date of formation of the District; and one member for each of the City and St. Louis County shall be appointed for terms of one year from the date of formation of the District. Thereafter each member appointed shall serve a four year term. Each member shall hold office until his or her successor has been appointed and qualified. In the event a vacancy exists or when a member's term expires, a successor member shall be appointed for the respective political subdivision as provided in such political subdivision's ordinance or order for the formation of the District. Members appointed to fill unexpired terms shall only serve until such unexpired term expires. Pending any appointment to fill any such vacancy, the remaining members may conduct Board business. The members of the Board shall select a Chairperson to serve for a term of one year; and such other officers as it deems necessary; the office of Chairperson shall be held, seriatim, by representatives of each political subdivision comprising the District.

11.03.070 Executive Board--Powers.

The Executive Board shall perform all functions and duties provided for, and have all powers granted to, Solid Waste Management District Executive Boards by the Act, as amended, including changing the name of the District, subject to the approval of the Missouri Department of Natural Resources.
