24.242 Collection and disposal

11.02.105 Division of Refuse Collection.

There shall be in the Department of Streets a Division of Refuse Collection. The Commissioner of Refuse Collection, who shall be appointed by the Director of Streets, shall be the head of the Division of Refuse Collection. The Commissioner of Refuse Collection is sometimes hereinafter referred to as the Refuse Commissioner; the Division of Refuse Collection is sometimes hereinafter referred to as the Refuse Division.

11.02.110 Duties of Refuse Commissioner.

The Refuse Commissioner shall be in charge of the collection and disposal of refuse. He shall appoint all officers and employees in the Refuse Division, and he shall establish such rules and standards and may proceed in any manner as may be necessary for the effective execution, administration, and enforcement of all ordinance provisions relating to the Refuse Division and the storage, collection and disposal of refuse.

11.02.115 Disposal programs with other communities.

The Refuse Commissioner may participate in refuse disposal programs with other communities, political subdivisions, and private persons pursuant to the City Charter and other applicable provisions of law.

11.02.120 Services universal.

All services performed by the Refuse Division under this chapter shall be provided without regard to race, creed, color, national origin, or geographic area.

11.02.125 Collection and disposal--Preparation requirement--Schedule.

The Refuse Division shall collect and dispose of refuse from residential premises when it is prepared and placed for collection as provided herein. Collections shall be made at regular intervals on collection days to be determined by the Refuse Commissioner, who is authorized to determine the points of collection when they are not designated in this chapter.

11.02.130 Collection from nonresidential premises authorized when.

The Refuse Division shall not remove, collect, or dispose of refuse from premises other than residential premises unless the Refuse Commissioner determines that such removal is necessary to protect the public health, or is ordered to make such removal by the Health Commissioner, or is ordered to make such removal by the Director of Streets to remedy an obstruction of streets or alleys or unless such removal, collection, or disposal is pursuant to a lawful contract recommended by the Director of Streets.

11.02.135 Containers provided at Refuse Commissioner's discretion.

The Refuse Commissioner may provide refuse containers for the storage of refuse from residential premises as provided herein and otherwise in his sole discretion.
