9.12.010 Commissioner--Deputy--Inspectors.

There shall be a commissioner of weights and measures, referred to in this title as the commissioner. There shall be a deputy commissioner of weights and measures and city inspectors of weights and measures, referred to in this title as the deputy commissioner and inspectors, respectively, and necessary technical and clerical personnel, who shall be appointed by the commissioner, with the approval of the director of public safety, from eligible lists prepared by the civil service board and under the rules of said board, and who shall collectively comprise the city division of weights and measures, of which the commissioner shall be the head. The commissioner shall be allowed for salaries for himself, the deputy commissioner, the inspectors, and the necessary technical and clerical employees, for necessary equipment and supplies, and for vehicles and contingent expenses, sums as appropriated by the board of aldermen.

9.12.020 Bonds.

A bond, with sureties, to be approved by the comptroller, and conditioned upon the faithful performance of his duties and the safekeeping of any standards or equipment entrusted to his care, shall forthwith, upon his appointment, be given by the commissioner in the sum of five thousand dollars, and by the deputy commissioner in the sum of five thousand dollars. The premiums on such bonds shall be paid by the city.

9.12.030 Commissioner--Powers and duties.

The commissioner shall have the custody of the city standards of weight and measure and of the other standards and equipment provided for by this title, and shall keep accurate records of the same. The commissioner shall enforce the provisions of this title. He shall have and keep a general supervision over the weights and measures offered for sale, sold, or in use in the city. He shall annually make to the director of public safety a report on all of the activities of his office.

9.12.040 Official guide.

In order that there may be eliminated from use, without prejudice to apparatus that conforms as closely as practicable to the official standards, those weights, measures, weighing devices, or measuring devices:

A. That are not accurate;

B. That are of such construction that they are faulty--that is, that are not reasonably permanent in their adjustment or will not repeat their indications correctly; or

C. That facilitate the perpetration of fraud, the commissioner shall use as his official guide in the enforcement of this title the specifications, tolerances, and regulations for commercial weighing and measuring devices, together with amendments thereto, as recommended by the National Bureau of Standards and published in National Bureau of Standards Handbook 44 and supplements thereto, or in any publication of the National Bureau of Standards revising or superseding Handbook 44, except insofar as these are specifically modified, amended, or rejected by action of the board of aldermen, and these specifications, tolerances, and regulations shall have the full force and effect of law. For the purposes of this title, apparatus shall be "correct" when it conforms to all applicable specifications, tolerances, and regulations; other apparatus shall be "incorrect."

9.12.050 Deputy and inspectors--Powers and duties.

The powers and duties given to and imposed upon the commissioner by Sections 9.02.070--9.02.120, 9.12.040, and 9.14.010--9.14.090 are given to and imposed upon the deputy commissioner and inspectors also, when acting under the instructions and at the direction of the commissioner.
