8.98.347 Required.

No person shall drive or operate a taxicab upon the streets of the city unless the person has a valid taxicab operator's license and is duly registered with the director of streets under the provisions of this chapter. This section and the prohibition herein shall not be applicable to any person who shall drive or operate a taxicab upon the streets of the city solely for the purpose of discharging a passenger or a parcel of merchandise which was picked up at a location outside of the city limits, or picked up in the city for delivery outside of the city.

8.98.353 Penalty for violation of Section 8.98. 347.

Any person convicted of a violation of Section 8.98.347 shall be punished as follows:

A. Any person convicted of a first offense shall be punished by a fine of not less than fifty dollars.

B. Any person convicted twice within twenty-four months shall be punished by a fine of not less than two hundred dollars.

C. Any person convicted three times or more within twenty-four months shall be punished by a fine of not less than five hundred dollars.

8.98.359 Registration forms.

A. Before a person operates a taxicab, the certificate holder of said taxicab shall file with the director of streets a registration form (in a form prescribed by the director of streets) along with the person's state chauffeur's license. The registration form shall contain the person's full name, residence, place or places of residence for the past five years, sex, age, race, height, color of eyes and hair, place of birth, length of time the person has resided in the city, citizenship of the person, places of previous employment, whether single or married, whether person was previously licensed as a chauffeur, whether the license has been revoked, and if so for what cause. The form shall be signed and sworn to by the person and filed in the department of streets as a permanent record.

B. For the above described forms the director of streets shall receive a fee of five dollars ($5.00) for each form submitted which fee shall be paid for by the person.

C. Any person, firm, or corporation, providing false information to misconstrue the facts required by the foregoing of this section shall be deemed guilty of a misdemeanor and, upon conviction, shall be fined the sum of not less than twenty-five dollars ($25.00), nor more than five hundred dollars ($500.00).

8.98.365 Sworn statement.

The certificate holder shall file with each form the person's sworn statement setting forth each and every conviction of the applicant for violations of federal, state or city laws, statutes or ordinances, or, in lieu thereof, a true and complete summary in writing of the person's police record as indicated by the records of the city police department and a certified copy of the applicant's Missouri driving record. The statement or summary of the applicant's police record shall be considered as part of the form.

8.98.371 Physical exam--Driving skills.

Each person desiring to operate a taxicab shall be required to submit to physical examination and if required by the director of streets, demonstrate his skill and ability to safely handle the vehicle.

8.98.377 Photographs.

The form shall be accompanied by four recent photographs of the person, at a size determined by the director of streets, two to be presented to Identification Section, Room 505, Police Headquarters, Tucker and Clark, one to be retained by the director of streets, and the other to be returned to the person to be displayed in the taxicab in accordance with Section 8.98.311.

8.98.383 Change of registration.

For a driver already registered with one certificate holder, who wishes to transfer to another certificate holder, this act may be complied with by the filing of a change of registration form, in a format to be developed by the director of streets.

8.98.389 Refusal.

When the certificate holder submits the form, the person shall be a validly registered taxicab driver and may be hired by the certificate holder. Such registration of a driver shall be subsequently revoked as well as suspension of his taxicab operator's license by the director of streets at any time that he finds that:

A. There is a misrepresentation, omission, or fraudulent or false statement on the form or person's sworn statement, or

B. The person has been convicted of a felony or misdemeanor involving moral turpitude on or subsequent to November 17, 1959; or

C. The person has been convicted of violating any state or municipal law, statute or ordinance by driving a motor vehicle under the influence of intoxicating liquor or narcotic drug within a two-year period to the filing of the application, or

D. The person has been convicted of violating any state or municipal law, statute or ordinance by leaving the scene of an accident; knowing that injury has been caused to a person or damage has been caused to property, without stopping and giving his name and residence, including city and street address, to the injured party, or to a police officer, or to other persons as required by law, within a two-year period to filing of the form, or

E. The person is physically unqualified to operate a motor vehicle; or

F. The person has been convicted of any felony in the commission of which a motor vehicle is used, on or subsequent to November 17, 1959; or

G. The person is a habitual drunkard or is addicted to the use of narcotic drugs; or

H. The person has failed to answer any taxicab or traffic violation summons as indicated by the records of the city courts;

I. Operating any vehicle as a taxicab not licensed as a taxicab by the city or St. Louis County.

8.98.395 Annual report and tax.

Each certificate holder shall annually, between January 1 and January 31 of each year, submit an annual renewal registration form for each driver, containing the same information and meeting the same requirements as the original registration form furnished by the director of streets, and each driver shall pay a charge of five dollars at the time of submission. A five-dollar penalty will be imposed upon the certificate holder for all annual renewal registration received after January 31 of each year.
