8.83.010 Findings.

The Board of Aldermen makes the following findings:

A. A number of new service stations have been built in the City which do not have facilities for providing compressed air and water for use in motor vehicles and which do not have restroom facilities which are open for use by the traveling public.

B. A number of older service stations which did have facilities for providing compressed air and water for use in motor vehicles and restroom facilities for use by the public have been demolished and replaced with new service stations which do not have such facilities available to the public.

C. Numerous service stations which do have facilities for providing compressed air and water for use in motor vehicles and restroom facilities have stopped making air and water available to the traveling public and have refused to allow the public to make use of their restrooms.

D. Some service stations which do make restroom facilities available for use by the public lock their restroom facilities during nighttime hours, thereby preventing use of such facilities by the public during those hours.

E. Provision by service stations of compressed air for the purpose of inflating tires will reduce accidents caused by handling problems resulting from underinflated tires and will therefore promote the public safety, health, and welfare. Provision by service stations of water for purposes of filling radiators and windshield washing reservoirs will reduce breakdowns and help drivers see the road more clearly, thus reducing the potential for accidents, thereby promoting the public safety, health and welfare.

F. Public health, safety and welfare will be promoted by making the public aware of whether or not restroom facilities are available for use by the traveling public at a particular service station.

8.83.020 Applicability of provisions.

The provisions of this chapter shall apply to all service stations within the City. For purposes of this chapter, a service station shall be defined as an establishment, having one or more fuel pumps, wherein a principle activity is offering for sale, to the traveling public, gasoline, diesel fuel or similar products used to provide locomotive power to motor vehicles.

8.83.030 Required services.

All service stations shall offer the following amenities and services, which must be provided or offered on the premises of the station, to the traveling public during regular business hours:

A. A properly functioning water spigot and hose suitable for use by the traveling public for the servicing of motor vehicles and which is so located so as to be readily accessible to the traveling public or, in the alternative, containers of fresh water which are made available to the traveling public for purposes of servicing motor vehicles.

B. Air compressors and attached hoses permitting motorists to replenish air loss from vehicle tires, together with appropriate gauges for measuring air loss. A reasonable charge may be levied by a service station owner or operator for the delivery of compressed air, and this charge may be collected by use of a coin-operated device for delivery of compressed air.

8.83.040 Sign to indicate no restroom available.

All service stations which do not have restroom facilities available for use by the public shall display one sign with the following wording: "NO RESTROOMS AVAILABLE." Such sign shall be placed either in the window or attached to the wall of the premises as provided by law; provided, that no such sign shall be painted directly on a wall. The sign shall be lettered in a professional manner with letters three (3) inches in height. No other information or graphic shall appear on said sign, except that if a service station makes restroom facilities available for only a portion of the time period during which it is open for business, then such information may be specified on the sign in letters smaller than three (3) inches in height.

8.83.050 Damaging or vandalizing property prohibited.

It shall be a violation for any person to vandalize, steal, intentionally destroy or damage, or remove from the premises any of the following items made available to, or provided for use by, the general public by the owner or operator of a service station: (A) toilet fixtures, urinals, sinks, other plumbing facilities, waste receptacles, towels, toilet tissue, soap, or soap receptacles; (B) water spigots, water hoses or containers of fresh water; or (C) air compressors and/or attached hoses.

8.83.060 Penalty for violation.

Any person, firm, corporation or other entity which is found guilty of a violation of either Section 8.83.030 or 8.83.040 shall be punished by a fine of not less than twenty-five dollars ($25.00) nor more than five hundred dollars ($500.00). Each day during which a service station fails to comply with the provisions of Section 8.83.030 shall be deemed a separate violation. Any person found guilty of a violation of Section 8.83.050 shall be punished by a fine of not less than one hundred dollars ($100.00) nor more than five hundred dollars ($500.00).
