8.44.010 Definitions.

For the purpose of this chapter, the following words and terms shall have the following meanings:

A. Information date bureau and date bureau means the business and practice of introducing persons of one sex to other persons of the opposite sex and of computing, congregating or otherwise assembling information relative to the personality, financial, psychological, character traits or other similar and related data of persons for the purpose of such introductions.

B. "Person" means any individual, association, club, joint stock company, syndicate, partnership, corporation, receiver, trustee, conservator or other officer appointed by any state or federal court.

8.44.020 License and permit required.

No person shall engage in the business of operating an information date bureau or date bureau, as those terms are defined herein, without a license and permit.

8.44.030 Application.

Any person desiring to engage in the business of conducting an information date bureau or date bureau shall make application to the director of public safety stating:

A. The names, addresses, and positions of the owners or proprietors and principal officers and managers;

B. The address of the premises where the business is to be conducted;

C. A description of the methodology to be used in conducting the information date bureau or date bureau;

D. A schedule of the charges and fees for the herein described services;

E. Other matters the Director may prescribe by rule or regulation.

8.44.040 Investigation--Permit issued.

Upon receipt of an application to engage in the business of conducting an information date bureau or date bureau, the Director shall make an investigation of the owners or proprietors and principal officers and managers and also inspect the premises where the business is to be conducted. In the event he finds that none of the owners, proprietors and principal officers or the managers of the information date bureau or date bureau have been convicted of a felony, a misdemeanor involving moral turpitude, or an ordinance violation involving moral turpitude, and if he further finds that the premises where the business is to be conducted is not frequented by convicted felons, prostitutes, male or female procurers, or other disorderly persons, then he shall issue a permit to conduct an information date bureau or date bureau.

8.44.060 Inspections and investigations.

The Director, on his duly authorized agent, shall make periodic investigation and inspections into the manner in which the information date bureau or date bureau is conducting its business and of the premises of each licensee, and may upon complaint made to his office, make such additional investigations and inspections as may be deemed necessary. In the event the Director shall find:

A. That a condition exists which would have caused a denial of an application under Section 8.44.040;

B. That the premises where the business is conducted is frequented or attended by felons, prostitutes, male or female procurers, or other disorderly persons;

C. That persons under the age of seventeen years have been accepted as customers or have received the services of the information date bureau or date bureau; or

D. That the licensee or the principal officers or management of the information date bureau or date bureau have been convicted for a violation of any of the terms or conditions of this chapter. Upon a finding of any of the above conditions, the Director shall cause the license to be revoked and notify the licensee in writing at the business premises of the decision.

8.44.070 Minors--Restrictions.

No person under the age of seventeen years shall apply for, or in any way receive, the service of an information date bureau or date bureau. Persons between the ages of seventeen and twenty-one years shall produce the written consent of his or her parent or guardian before becoming eligible to receive such service.

8.44.080 Minors--Misrepresentation of age.

No person shall accept as a customer, or in any way provide services of an information date bureau or date bureau to persons under the age of seventeen years except as provided in Section 8.44.070. The misrepresentation of the age of any person who has not attained the age of seventeen years shall not excuse the licensee from complying with the terms and conditions of this chapter.

8.44.090 Persons not allowed on premises.

No licensee or his employees shall allow a convicted felon, prostitute, male or female procurer, or other disorderly persons to frequent or be in attendance of the premises of an information date bureau or date bureau.
