8.34.010 Dance studio and operator defined.

"Dancing studio" is hereby defined as a place where the art of dancing in any of its forms is taught to persons for compensation, and shall include all forms of dancing.

"Operator" is hereby defined as any person, firm or corporation or employee or agent thereof.

8.34.020 Rate schedule.

No person, firm or corporation shall operate or cause to be operated within the city a dancing studio without first publishing a schedule of rates or charges setting forth therein the rate or charge per lesson, per hour or per instructional performance for instruction. The schedule is required to be located in a conspicuous place within the dancing studio. The operator of the dancing studio shall direct the attention of each person to the schedule of rates or charges prior to entering into any contract or agreement for dancing instructions. Should any person desiring to receive dancing instructions be a minor, then the attention of the parent or legal guardian of the minor shall be directed to the schedule of rates or charges prior to the entering into any agreement for dancing instructions. The schedule of rates and charges shall state clearly therein the rate of instructions per hour, half-hour or quarter of an hour, or other period of time designated by the operator, or the rate per lesson and the duration of the time for lesson, or the rate per course with a full description of the dancing course set forth therein.

8.34.030 Intent.

It is the intention of this chapter to prevent frauds from being perpetrated on persons desiring or contracting for dancing instructions by requiring the operators of dancing studios to post the rates of dancing instructions.

8.34.040 Contracts to comply with advertising.

Any operator of a dancing studio who shall place advertisements in any newspaper, magazine, or other periodical, offer to the public free dance lessons, or dancing instructions, the rates thereof or other inducements for the purpose of attracting persons to enter into any contract for dance instruction, who shall fail or refuse to enter into a contract as set forth in the advertisement, according to the terms of the advertisement shall be deemed guilty of a misdemeanor and shall be fined upon the conviction thereof the sum provided in Section 8.34.050.

8.34.050 Penalty for violations.

Any person, firm or corporation operating, or causing to be operated, a dancing studio who shall fail to comply with the provisions of this chapter shall be deemed guilty of a misdemeanor and upon conviction shall be fined not less than one hundred dollars, nor more than five hundred dollars, and each day shall constitute a separate violation.
