8.106.010 License--Required.

No person shall engage in or carry on the business of undertaker in the City, take charge of, supervise or manage any funeral in the City for pay, without first having paid to the License Collector the license tax described in Section 8.106.020.

8.106.030 License--Gross receipt statement.

Each applicant for a license shall make a statement to the License Collector on or before the first day of July of each year of the amount of his gross receipts from the business in the City during the preceding year.

8.106.040 License--Permanent place of business.

Licensed embalmers shall be eligible for licensing as undertakers without further qualification upon payment of the fees requisite thereto. No other person, firm, partnership, corporation or company shall hereafter be eligible for license as an undertaker unless the person, firm, partnership, corporation or company shall have a permanent place or places under his or its direction and control at which place or places such business is conducted, the location of each place to be set forth in the application for license under this chapter.

8.106.050 License--Separate for each place of business.

Each undertaker desiring to operate, engage in or carry on the business of an undertaker shall secure a separate license for each location in which to carry on such business.

8.106.060 Place of conducting funeral.

No undertaker shall conduct a funeral from any place other than the licensed premises except from the private home of the deceased person or a church.

8.106.070 Equipment required.

Each location shall at all times contain equipment and fixtures specially designed for and used in undertaking, including ordinary furnishings but exclusive of any motor vehicles, of the assessed personal property value of at least one thousand dollars before any undertaking license shall be granted.

8.106.080 Surrender of body.

No undertaker shall refuse to surrender a dead human body upon request by the next of kin, legal representative or other person lawfully entitled to the custody and control of the body.

8.106.090 Obtaining possession of body--Authority.

No undertaker shall obtain possession of or embalm a dead human body without express authority to do so from the next of kin, legal representative, or other person lawfully entitled to the custody and control of the body.

8.106.100 Obtaining possession of body--Commissions or rewards.

No undertaker directly or indirectly, shall pay or offer to pay any money or other thing of value, himself or by his agents or employees, to any person nor offer to pay a commission or other reward, emolument or thing of value whatsoever, himself or by agent or employee, for the purpose of obtaining a dead body for embalming, for a funeral or funeral service, or for burial, cremation or preparation for shipment of the body to any other place.
