Art. XV 2 Comptroller

5.04.010 Appointment of officers and employees.

The Comptroller shall appoint in accordance with the Charter and ordinances of the City all officers and employees in his main office and in the divisions created by Section 5.02.010. The officers and employees shall in addition to their regular work perform duties as assigned to them by the Comptroller.

The Comptroller shall appoint, in accordance with the Charter and the ordinances of the City, one Deputy Comptroller, one Budget Director, one First Assistant Comptroller, one Second Assistant Comptroller, one Supervising Accountant and Statistician, one Division Head, two Assistant Division Heads and employees as necessary to perform the work of the department.

5.04.020 Deputy Comptroller.

The Deputy Comptroller shall perform all the duties assigned to him by the Comptroller and shall in the case of the absence or sickness of the Comptroller perform all duties of the Comptroller. He shall give a bond to the City in the sum of fifty thousand dollars ($50,000.00).

5.04.030 First and Second Assistant Comptroller.

The First Assistant Comptroller and the Second Assistant Comptroller shall perform duties as the Comptroller may direct. The First Assistant Comptroller in the case of the absence or sickness of the Comptroller and Deputy Comptroller shall perform all the duties of the Comptroller. The Second Assistant Comptroller shall in like manner perform all the duties of the Comptroller in the case of the absence or sickness of the Comptroller and Deputy Comptroller and First Assistant Comptroller.

5.04.040 Use of Acting Comptroller title.

When performing the duties of Comptroller, the Deputy Comptroller, the First Assistant Comptroller, and Second Assistant Comptroller shall designate themselves respectively as Acting Comptroller.

5.04.050 Countersignature of Comptroller to special tax bills--Designation--Filing.

The Comptroller is authorized to designate any person in his department to countersign his name to special tax bills issued under the authority of law or ordinance. Such designation shall be in writing and on the same sheet of paper therewith. Each person so designated shall write the signature of the Comptroller in the form in which he will so countersign special tax bills. Such written designation shall then be filed in the Office of the Register and thereafter the Comptroller shall have adopted as his own such signature to any special tax bills so countersigned.

5.04.060 Countersignature of Comptroller to special tax bills--Designation--Revocation.

The Comptroller may, at any time, in writing filed in the Office of the Register, revoke any designation made by him under the authority of this chapter, and may designate any other assistant or clerk or subordinate to countersign special tax bills as provided in Section 5.04.050.

5.04.070 Employment of experts.

The Comptroller is authorized and directed to employ experts, bookkeepers, accountants, clerks and other help as necessary to have a thorough investigation made of the systems of accounting in use by other municipal corporations and of the methods of accounting now used in the municipal departments of the City and to install new systems or make change in the present systems in the departments of the City as he may deem advisable after investigation.

5.04.080 Accounting control over assessments.

The Comptroller is authorized to install a method that will give his department accounting control over the assessment of property and the making out of tax bills, therefor, that will effectively prevent the occurrence of errors or omissions in the registration of assessments or in the making out of tax bills, to employ a firm of public accountants to install the method under supervision of the Comptroller and to procure supplies necessary to complete installation and control.

5.04.090 Leasing City property.

The Comptroller is authorized, with the approval of the Board of Estimate and Apportionment, to lease any property of the City, not immediately needed for municipal purposes, for a term not to exceed five years, at a rental as fixed by the Board of Estimate and Apportionment.

5.04.100 Auditor of Sheriff's Office.

The Comptroller is authorized and directed to employ an auditor whose duties shall be primarily to check and verify the books of record and of accounts of the Sheriff of the City and to render other services as required of him.

5.04.110 Bond Clerk--Assistant Bond Clerk.

The Comptroller is authorized to employ a Bond Clerk and an Assistant Bond Clerk. The Bond Clerk shall be employed in the preparation of, sale and delivery of bonds, and in recording bond sales, payment of accruing interest and maturing bonds, and other work assigned to him by the Comptroller. The Assistant Bond Clerk must be a stenographer whose duty it shall be to attend all meetings of the bond committee, take notes of the proceedings thereof, and transcribe same for information of the departments and officials of the City concerned. He shall do other work as assigned to him by the Comptroller.

5.04.120 Contingent fund.

There shall be appropriated and set aside annually out of general municipal revenue the sum of fifteen thousand dollars ($15,000.00) to be used by the Comptroller as a contingent fund. The fund shall be used by the Comptroller at his or her discretion. The Comptroller shall make a report to the City Register for the use of the fund in the aggregate amounts for each of the following categories:

A. Civic and charitable contributions;

B. Memberships;

C. Comptroller's office miscellaneous expenses;

D. Flowers and gifts;

E. Entertainment, lobbying and other business related activities;

F. Personal.

5.04.130 Contingent fund report--Required.

The Comptroller's obligation to file said report as called for in Section 5.04.120 shall be construed as mandatory, and shall be considered and construed to be a condition precedent to drawing any funds against the following fiscal year's contingency fund, whether said following year's contingency fund has been approved by the passage of an approved budget for the City, of which said contingency fund shall be a part, or whether the contingency fund is merely proposed and the City is operating under the authority of a continuing resolution.

5.04.140 Contingent fund report--Filing--City Register.

Such report shall be kept by the City Register and shall be available to the public upon request. The City Register shall certify to the Comptroller that the Comptroller has complied with the provisions as set forth in Sections 5.04.120 and 5.04.130. The report shall be filed with the City Register on April 16th of each year or the next business day thereafter.

5.04.150 License Collector duties--Transference.

A. All responsibilities, duties, obligations for the collection of municipal taxes, fees and disbursement of taxes and fees collected that have heretofore been performed by the License Collector shall be transferred to the Comptroller of the City. The Comptroller is hereby authorized and directed to enter into an agreement with the Collector of Revenue to perform the function of collecting amounts for license taxes and fees.

B. Subsection A shall not apply to actual issuance of licenses or the processing of tax reports for the declaration of payment of taxes on machinery and tools of merchant and manufacturers as required by Chapter 150 of the Revised Statutes of Missouri.
