Enhanced Enterprise Zone Board

3.81.010 Established--Terms.

Pursuant to Section 135.957 of the Revised Statutes of Missouri 2000, as amended, there is hereby established a seven-member Enhanced Enterprise Zone Board of the City of St. Louis, Missouri (the "EEZ Board") to operate within the boundaries of the City of St. Louis, Missouri. The members of such EEZ Board shall be the following, pursuant to Section 135.957 RSMo.: One (1) member shall be appointed by the St. Louis Board of Education; one (1) member shall be appointed by other affected taxing districts; and the remaining five (5) members shall be appointed by the Mayor as the Chief Elected Official of the City of St. Louis. The Board of Education member and the other affected taxing districts members shall each have initial terms of five (5) years. Of the five (5) members appointed by the Mayor, two shall have initial terms of four (4) years, two shall have initial terms of three (3) years, and one shall have an initial term of two (2) years. Thereafter, members shall serve terms of five (5) years. All vacancies shall be filled in the same manner as the original appointment. For inefficiency or neglect of duty or misconduct in office, a member of the EEZ Board may be removed by the applicable appointing authority. The members of the EEZ Board annually shall elect a Chair from among the members. A majority of the members shall constitute a quorum of such EEZ Board for the purpose of conducting business and exercising the powers of the EEZ Board and for all other purposes. Action may be taken by the EEZ Board upon a vote of a majority of the members present. The EEZ Board shall adopt by-laws governing the conduct of its proceedings consistent with applicable statutes and with this chapter.

3.81.020 Powers and duties.

The EEZ Board is hereby authorized to exercise those obligations, duties, powers and functions authorized by Sections 135.950 through 135.973 RSMo., as the same may be amended or revised from time to time, to conduct the activities necessary to advise the Board of Aldermen on the designation of Enhanced Enterprise Zones in the City of St. Louis, to perform any other advisory duties with respect to such zones by the Board of Aldermen, to perform reviews and assessments of zone activities as such activities relate to the annual reports as set forth in Section 135.960 RSMo.

3.81.030 Amendments.

It is hereby recognized that the requirements of Missouri Statutes as pertain to the number, qualifications, terms and manner of appointment of persons to serve on the EEZ Board may, from time to time, be revised. The Mayor and such other persons as may be authorized to act with respect to appointments to the EEZ Board under Missouri Statutes in the future are hereby authorized to act in accordance with Missouri Statutes, as from time to time revised, so that at all times hereinafter the EEZ Board shall be and remain legally authorized to exercise the powers of an EEZ Board under Missouri Statutes, without further action of the Board of Aldermen.

3.81.040 Appointment.

The Mayor of the City of St. Louis is hereby authorized to make the appointments referenced as mayoral appointments in Section 3.81.010, within thirty (30) days following March 3, 2006. The St. Louis Board of Education is hereby authorized to make the appointment referenced as the Board of Education appointment in Section 3.81.010. The other affected taxing districts are hereby authorized, collectively and as a group, to make the one appointment referenced as the other taxing districts appointment in Section 3.81.010.

3.81.050 Duties of Board of Aldermen.

Upon adoption of this chapter, the Clerk of the Board of Aldermen is hereby directed to promptly, by certified mail, return receipt requested, notify the St. Louis Board of Education that such Board of Education is authorized to appoint one person to the EEZ Board, and that such appointment shall be effective upon the later of March 3, 2006 or the date upon which such Board of Education makes such appointment. Upon adoption of this chapter, the Clerk of the Board of Aldermen is also hereby directed to promptly, by certified mail, return receipt requested, notify the other affected taxing districts that such districts are, collectively and as a group, authorized to appoint one person to the EEZ Board, and that such appointment shall be effective upon the later of March 3, 2006 or the date upon which such districts make such appointment. Such notifications shall request that the Board of Education and the other affected taxing districts make such appointments within thirty (30) days from March 3, 2006.
