3.58.010 Established--Membership.

There is established the city athletic commission to consist of seven members, all of whom shall be members of the legislation committee of the Board of Aldermen. The chairman of the public safety committee and the president of the Board of Aldermen shall be ex officio members of this commission.

3.58.020 Appointment.

The members of the commission shall be appointed by the Mayor for the term of two years. If any member of the commission during the term for which he is appointed shall cease to be a member of the legislation committee of the Board of Aldermen, the tenure of his office as a member of the city athletic commission shall cease immediately and the Mayor shall appoint another member of the legislation committee of the Board of Aldermen as his successor on the commission to fill the unexpired term for which he was appointed.

3.58.030 Compensation--Organization.

The members of the commission shall serve without compensation. At their first meeting after their appointment, the members shall elect one of their members as chairman and another as secretary of the commission. Four members of the commission shall constitute a quorum, and the concurrence of at least a majority of the members present shall be necessary to render a decision of the commission.

3.58.040 Office space.

The city athletic commission shall be assigned office room in the city hall.

3.58.050 Powers and duties.

The members of the city athletic commission shall adopt a seal for the commission.

The commission shall make rules governing boxing, sparring and wrestling exhibitions in the city, not inconsistent with the laws of the state, the ordinances of the city, or the lawful regulation of the state athletic commission, as they deem necessary to secure compliance with the law and to prevent evasions thereof.

The commission shall also have the following powers:

A. The commission shall have access to any boxing, sparring or wrestling exhibition without the payment of admission fees;

B. To issue subpoenas for, and compel the attendance of, witnesses and the production of any books, papers and documents before the commission; and to examine witnesses, under oath, in any hearing and investigation by the commission in the discharge of its duties. These subpoenas shall be signed by the chairman or secretary of the commission and be attested by the seal of the commission:

1. Each commissioner shall have authority to administer oaths and affirmations to witnesses,

2. Any witness who shall have been personally served in the city with a subpoena issued by the commission, commanding the attendance of such person or the production of any books, papers or documents, who shall fail or refuse; without reasonable or legal excuse, to attend at the time and place specified, or who shall fail or refuse, without reasonable or legal excuse, to produce the books, papers or documents therein specified, shall be subject to attachment of his person and commitment to jail,

3. Any witness, being present at a hearing or investigation, who fails or refuses to testify or to produce books, papers or documents without reasonable or legal excuse, shall be committed to jail by the commission, there to remain until he testifies or produces the books, papers or documents,

4. Attachments issued by the commission shall be under the hand of the chairman or secretary, attested by the seal of the commission, and shall be served by the city marshal or one of his deputies.

3.58.060 Permits for exhibitions.

No boxing, sparring or wrestling exhibitions shall be held within the city without first obtaining a permit from the commission. The organization desiring to hold an exhibition shall have a license as provided for in Chapter 8.96.

3.58.070 Disbursements.

The city athletic commission shall have the power to authorize disbursements covering the necessary expenses incurred in the performance of its duties. The total amount of disbursements in any one year shall not exceed the appropriation granted for that year.

3.58.080 Inspections.

The City Athletic Commission shall appoint inspectors not to exceed nine in number. The inspectors shall attend all sparring, boxing and wrestling exhibitions held within the City, and shall perform duties as may be assigned to them by the commission. The inspectors shall be paid five dollars per night for each night that they actually attend any exhibition. They shall be authorized to wear a shield or badge inscribed with the words "City Athletic Commission Inspector," and shall have authority to arrest any person who violates any of the provisions of this or the laws of the state relating to wrestling exhibitions.

3.58.090 Annual report.

The City Athletic Commission shall make a full report covering the period of the fiscal year, which shall be filed with the Mayor not later than the first day of August of each year. A copy of this report shall be filed with the City register on the same date. The commission shall make further reports as are required by any ordinance of this City.
