ADDENDUM

The following examples were developed to provide guidance for the administration of the "hours worked" provisions found in Section 15 of Ordinance 68711, effective July 18, 2010.

Most examples are for an Overtime Code 3 employee (overtime rate 1.5x) who is normally scheduled to work forty (40) hours per week, eight hours per day, off days are Sunday and Saturday, off on holidays. Changes to this scenario are listed with the specific example.

Abbreviations - ST OT, FLSA OT, DOCKS, etc. - refer to the columns on the Time Sheet used by department payroll personnel to submit their department's time to the Comptroller's Payroll Section.

In addition to "actual hours worked" authorized scheduled paid time off (vacation, compensatory time, holiday) and any incurred furlough in a regularly scheduled work day shall count as hours worked for the purpose of determining eligibility for overtime compensation. Medical leave, sick leave, compassion leave, jury leave, and any unscheduled time off (call in) will not count for actual hours worked in the calculation of overtime.

Normal overtime threshold is 40 hours. Overtime threshold for the week containing furlough on a regularly scheduled work day shall be 32 hours for the purpose of determining eligibility for overtime compensation.

Note: Only OVTM Code 3 and 4 employees shall include furlough for overtime calculations.

EXAMPLE D: Furlough not incurred (falls on off day)
(40 Hour Threshold for Overtime)

In this example, Overtime Code 3 employee works Tuesday through Saturday, eight hours/day, since the designated furlough day falls on his day off, not his scheduled work week, his appointing authority will need to reschedule another eight hour furlough before June 18, 2011.
